Terms and Conditions & Informed Consent

Entity: WITFL Holdings, LLC, a wholly owned subsidiary of Z Athlete Group, Inc. (“WITFL Holdings” or “WITFL”)

1. Overview

These Terms and Conditions govern all participation in World Indoor Track & Field League (WITFL) and TrackFIT™ events, including the TrackFIT Challenge, Regional Combines, Developmental League competitions, and the WITFL Games (collectively, “Events”).

By registering or participating, you acknowledge and agree to these Terms, including the use of your name, image, likeness, results, performance data, and interviews in all forms of media, and consent to the collection of athletic and motion data as part of WITFL’s official systems.

2. Eligibility

Participants must be 13 years of age or older at the time of registration.
Participants under 18 must have consent from a parent or legal guardian.
All participants must be legally authorized to compete in the jurisdiction where the event occurs.
Additional eligibility requirements may apply for scholarship or prize divisions.

3. Registration and Participation

Registration must be completed through official WITFL platforms such as worlditfl.com, trackfitchallenge.com, or authorized partner sites.
Once submitted, registration fees are non-refundable except in cases of event cancellation by WITFL Holdings.

By registering, you affirm that:

You are physically fit and medically cleared to participate in athletic competition.
You will comply with all WITFL rules, event protocols, and safety procedures.
You accept full responsibility for your own health, conduct, and preparation.

4. Athlete Data and Technology Consent

Participation in WITFL Events includes the use of motion capture, biometric, and timing technologies designed to measure and verify athletic results.

You acknowledge and consent to WITFL’s collection and analysis of your performance and movement data through proprietary systems including, but not limited to:

Motion DNA™ Signature Tracking
EchoTrak™ LiDAR-based measurement systems
My Assistant Coach™ and ThermoDNA™ integrations

This data may be used to evaluate athletic results, generate reports, produce rankings, and enhance the athlete experience.
Aggregated or anonymized data may be used for research, education, or technology development purposes.

All intellectual property, analytics, and outputs remain the exclusive property of WITFL Holdings, LLC and Z Athlete Group, Inc.

5. Media, Streaming, and Broadcast Rights

WITFL events are athletic competitions that may be recorded, live-streamed, or broadcast through official WITFL and partner channels.
By participating, you grant WITFL Holdings, Z Athlete Group, and their affiliates, sponsors, and media partners the unrestricted right to record, edit, reproduce, distribute, and publicly display your name, likeness, image, voice, performance data, and interviews for:

Event streaming and highlight coverage
Social and digital media clips
Educational and promotional content
Broadcast or documentary features
Advertising or sponsorship integration

These rights extend worldwide and in perpetuity, without any additional compensation, and may be sublicensed to authorized partners strictly for WITFL-related use.

6. Competition Pathway

Participation in WITFL is structured around measurable athletic results and open progression:

TrackFIT Challenge – Baseline testing and open competition to establish your TrackFIT Score.
Regional Combines – Competitive qualifying events that determine advancement.
WITFL Games – The championship-level event showcasing top qualifiers from across all divisions.

WITFL may adjust formats, scoring, or qualification criteria at its discretion to preserve fairness, safety, and competitive integrity.

7. Prizes, Scholarships, and Awards

Participants aged 14+ with no remaining collegiate eligibility may be eligible for cash awards or professional contracts.
Participants maintaining high school or collegiate eligibility may receive scholarships or equivalent educational awards only.
Prize deferrals may be offered to preserve amateur athletic status under NCAA, NAIA, or NJCAA rules.
Employees, agents, or immediate family members of WITFL Holdings, Z Athlete Group, or their sponsors are not eligible for cash prizes.

All awards will be distributed in compliance with applicable amateur athletic regulations.

8. Conduct and Fair Play

All athletes, coaches, and affiliates must uphold WITFL’s Code of Conduct, which emphasizes safety, respect, and integrity.
Unsportsmanlike behavior, doping, cheating, harassment, or rule violations may result in suspension, disqualification, or removal from WITFL participation without refund.

9. Waiver and Release of Liability

Participation involves physical activity that carries inherent risks, including injury, illness, or death.
By participating, you voluntarily assume all risks and agree to release, discharge, indemnify, and hold harmless:
WITFL Holdings, LLC, Z Athlete Group, Inc., event hosts, sponsors, venues, coaches, volunteers, and all affiliated personnel from any and all claims, losses, or damages arising from or connected with your participation, travel, or event attendance.

This release applies to injuries or damages caused by negligence, equipment failure, facility conditions, or any other circumstance connected with WITFL participation.

10. Confidentiality and Intellectual Property

All proprietary data, reports, graphics, or analytics derived from WITFL systems are the property of WITFL Holdings and Z Athlete Group.
Athletes may access their personal Motion DNA™ or TrackFIT results for individual reference but may not copy, reproduce, publish, or redistribute proprietary materials for commercial use without written authorization.

11. Governing Law and Arbitration

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada.
Any dispute, claim, or controversy arising from participation in WITFL shall be resolved exclusively by binding arbitration under the rules of JAMS in Clark County, Nevada, before a single neutral arbitrator experienced in sports or entertainment matters.
WITFL Holdings may seek injunctive or equitable relief outside of arbitration to protect its intellectual property, brand, or confidential data.
The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs enforcement of this clause.

12. Consent and Acknowledgment

By registering or participating in any WITFL or TrackFIT event, you confirm that you:

Have read and understood these Terms and Conditions.
Consent to recording, broadcast, and data collection for official use.
Accept and assume all risks associated with participation.
Agree to follow all event rules, codes of conduct, and competition policies.

If under 18, your parent or guardian must review and consent on your behalf.
